HEALTH GUARANTEE

--This puppy is being placed as a show/breeding prospect, and is being sold with Full AKC Registration, The puppy has been evaluated by the seller to be show/breeding prospect, this does not in any way guarantee you a show or breeding dog, but a puppy that at the time of placement appeared to have show/breeding potential. If at any time the seller is made aware that a puppy that was placed for show and the buyer is not showing the puppy and their sole purpose of getting the puppy is to capitalize on the Champion genetics the puppy must be returned to the seller at the buyer's expense. AKC records can be checked to see if the puppy is being shown, if not the buyer agrees to spay or neuter said puppy or return said puppy to the seller at the buyer's expense ________

--Buyer understands and agrees that any puppy purchased with Full AKC registration must have Lily's as the prefix to their AKC registered name (this choice is up to the seller's discretion)._________

--when being placed in a show/breeding potential home I do guarantee bite is good, both testicles are down and patella's are good at the time they leave here and are checked by a licensed veterinarian, Luxating Patella's --If buyer has bought the puppy for breeding/show, and finds puppy to have severe luxation within 12 months of placement, Seller will offer replacement (seller's discretion) upon return of puppy and all documents signed over to Seller. Return of said puppy will be at the buyers expense. All Show puppies will be certified by my vet to have sound knees, but due to possible injuries while in the buyers care this has to be evaluated on a case by case merit by two Licensed Vets and these costs are the responsibility of the Buyer. (We have never produced a puppy with bad knees). We do require a full in depth investigation from two licensed Vets to determine if the puppy has luxation genetically or if it has been caused by injury. Types of Injuries are as follows:

1.Cranial Cruciate Ligament Rupture which occurs suddenly from traumatic injury (This ligament holds the upper leg bone (Femur) to the lower leg bone (Tibia).

2.Patella Fracture which usually occurs due to a direct blow to the knee cap.

3.Patella Tendon rupture which can be caused by stepping wrong up to steps or down stairs ect.

4.Collateral Ligament injury.

I do not warranty Patella Luxation if caused by injury. If said puppy is found to have genetically bad knees the Buyer may place the puppy into a pet home and receive 1/2 of the money paid for the puppy back. The Seller determines which of these methods is best suited for the puppy's best interest (to avoid placing puppy into multiple homes) and the Seller and Buyer's best interest._________

--Per Agreement of the seller and buyer the puppy will be raised within the home and not in a kennel._______

Seller does not warrant against the following:

--Backward Sneezing-This is a common element in a Chihuahua when they get excited, and has not been found to impose a health risk but can get your attention, generally there is no need for alarm._______

--Coccidia/Giardia- Many Puppies/Dogs are prone to outbreak of either Coccidia and or Giardia under stressful circumstances. The symptoms can arise in a twelve hour period and cannot always be prevented by the Seller, because there are no signs until the puppy/dog is stressed and the immune system drops. The buyer should take the puppy/dog to their vet immediately if the puppy develops unusual stools, begins vomiting or has loss of appetite._______

--Molera- It is acceptable for the Chihuahua to have a molera, and should not be considered a flaw (you can find supporting information on the Chihuahua club of America Website and the AKC Website)._______

--Hypoglycemia-under no condition is the Seller responsible for the loss or death due to hypoglycemia. Seller is not responsible for any vet costs once the puppy is in the Buyers possession._________

-- (When a puppy is being placed as a SHOW puppy and not show POTENTIAL it must be at least 6 months of age to be placed as a SHOW puppy, otherwise it is show potential.) _________

--There is no guarantee on SIZE, COLOR, COAT, AND/OR BREEDING ABILITY OF THIS PUPPY. When SHOW puppies are purchased at the full show price and not a reduced pet price the seller guarantees breeding ability and if not viable the dog will be replaced. (When one of equal value, which is determined by the seller, becomes available) after proof of spay/neuter is provided to seller and all paperwork must be signed back over to seller and returned to seller. If the buyer chooses to keep the puppy and it was purchased at full show price, at no time will more than 1/2 the amount paid be offset. Returning the puppy is always at the buyer's expense. To prevent puppy/dog from being shipped again and the multiple placements seller can require said puppy be placed into a pet home "Approved" by the seller. When said puppy is placed into a pet home (spay/neutered) at no time will over half the purchase price be given back to the buyer.________

--If the puppy is placed in another home it must be spayed/neutered for the males it is agreed to not stud outside and is for buyer use only, unless you have written permission of Lily's Chihuahuas (Tina Ortiz). We have this condition to protect our bloodlines from being mixed with the Merle Gene. If no Merles are found in the female's pedigree and the breeder's pedigrees are Merle free we do not restrict outside breeding of the Lily's Chihuahua's male but you must have written permission at all times. Any puppy with the Lily's Chihuahuas bloodline is never to be crossed into Merle Chihuahua bloodlines. This includes but not limited to NO Merle bloodlines crossing using other dog registries.______

--At no time will Lily's Chihuahuas be used in a designer/hybrid breeding program._______

--Buyer agrees to never breed any Merle or Merle lines to any pup or the offspring of Lily's Chihuahuas lines and Buyer also agrees not to place any puppies from Lily's Chihuahuas lines in homes that breed or own any Merle or Merle lines_______

--Buyer warrants that he/she will not knowingly offer this puppy or any of its offspring to brokers, pet shops, puppy mills or Merle Breeders. If buyer is found to be selling the puppies in such a way compensation for damages will be sought by the seller. Buyer agrees to incur a $1,000 penalty for each puppy found to be sold this way. If the buyer ever needs to find the puppy a new home buyer will contact the seller for first right of refusal. Under no circumstances will this puppy be surrendered to a shelter or put to sleep without first consulting with the seller. To ship or for us to pick the puppy up will be at the buyer's expense______

--All offspring derived from Lily's Chihuahuas if NOT sold with a show contract MUST be placed with a spay/neuter contract, and with Limited AKC Registration. it is agreed by the seller and buyer any puppy placed with Full AKC Registration will be with the same conditions of this contract._______

--Any offspring with the Lily's Chihuahuas bloodline that does not fall within the guidelines of this contractual agreement must be spayed or neutered. If this contract is violated Lily's Chihuahuas would be allowed the possession of the puppy with all paperwork signed over to Tina Ortiz. In this situation there would be no refunds and any expenses in retrieving and/or legal action would be at the buyer's expense._______

--There are no other guarantees/warranties given, expressed or written, other than those stated in the above contract. Any changes must be made on paper, and signed by both seller and buyer. Should any disputes arise with the Buyer/Seller that cannot be resolved between the parties either party may seek resolution through legal means. It is agreed by both parties, (buyer/seller) jurisdiction will be within the State of Michigan.______
